The Peoples Democratic Party (PDP) has dragged the All Progressives Congress and its Caretaker Committee Chairman, Mai Mala Buni, to the Abuja Federal High Court.
The PDP is praying the court to effect the removal of Buni as the governor of Yobe State, on the argument that he cannot be occupying the office of the APC chairman and Yobe State governor at the same time.
This was contained in a four-page originating summons the counsel to the opposition party, Emeka Etiaba, filed at the court on Thursday.
He urged the court to make the governor appear before it and defend whether or not he ceased to be Yobe State governor by accepting to be the caretaker committee chairman of the APC.
Part of the originating summons said that Buni breached the provision of Section 183 of the constitution when as a governor, he also serves as the ruling party’s caretaker chairman.
Joined as plaintiffs in the suit marked FHC/ABJ/CS/885/2021 were the Yobe State PDP Governorship Candidate in 2019, Umar Iliya Damagum, and his running mate, Baba Abba Aji.
The defendants were Governor Buni, his deputy, Idi Barde Gubana, the APC, and the Independent National Electoral Commission (INEC).
The suit by the opposition is coming after the minority ruling of the Supreme Court in judgement case between the Ondo State Governor Rotimi Akeredolu, and Mr Eyitayo Jegede – the PDP candidate in the Ondo Governorship election of 2020.
First News reported the apex court had held that the Buni-led APC Caretaker Committee was illegally constituted.
