The Federal Court sitting in Kaduna on Friday struck out the case filed by Sani Sha’aban seeking nullification of Uba Sani as Kaduna State All Progressives Congress governorship candidate, for lack of jurisdiction.
Delivering his judgment, the presiding judge, Justice Mohammed Garba Umar said that the case aside lack of jurisdiction, was also in contravention of provision of the National Judicial Council policy direction.
Lead counsel to Uba Sani, Sanusi Musa Esquire, expressed satisfaction with the ruling.
Similarly, the Kaduna State Secretary of the APC, Yahaya Baba Pate, welcomed the judgment, saying the party is one family and will reach out to all aggrieved members to consolidate for a successful elections
On his part, John S. Mshelia Esq, lead counsel to the plaintiff, Sha’aban said he would wait for the instruction of his client on the next step to be taken.
Sha’aban had on 20th June, dragged Uba Sani and other APC stakeholders before the Federal High Court where he alleged that the primary that produced Sani and others as candidates for the 2023 polls should be declared null and void.
He added that the party’s statutory delegates were substituted by people who could barely read or write, to do the bidding of Sani and his sponsors.
