Justice Binta Nyako of the Federal High Court, Abuja, on Wednesday struck out the newly amended six counts the Federal Government filed against the embattled leader of the Indigenous People of Biafra, Nnamdi Kanu.
The development came after the Federal Government withdrew the charges following an objection raised by the counsel to Mr Kanu, Mike Ozekhome (SAN).
Ozekhome had complained that the prosecution was trying to delay processes by continuous amendment of the charge against his client.
He said the fresh amended charges would be the seventh time the Federal Government was amending its charge against his client.
Justice Nyako, who concurred with Ozekhome, said that Kanu was not expected to take a plea on those newly amended charges immediately, as he needed time to digest them before doing so.
Earlier, Justice Nyako had struck the bail application by the IPOB leader, saying that the issue of Kanu’s disappearance from Nigeria in 2017, should be determined first before his bail application would be entertained.
The trial judge, further noting that Kanu breached his former bail conditions, said until that is heard, his present bail application is immature.
