Justice Obiora Egwuatu of the Federal High Court in Abuja has sacked a motion filed by the Department of State Service (DSS) seeking confinement of four out of the 12 aides of Yoruba self-determination agitator, Sunday Igboho.
The motion was ruled out by the Judge on Tuesday following its dramatic withdrawal by counsel to the DSS, Mr Idowu Awo.
As the matter was about to be heard, the DSS lawyer shocked the court by announcing that he will not go ahead with the motion.
He said, instead, he had filed a notice of appeal against the bail granted to the four out of the 12 detainees and that he would rather pursue the appeal at the Court of Appeal.
Justice Egwuatu, therefore, expunged the motion following the no objection by the detainee’s lawyer, Mr Sunday Adebayo.
