Osun PDP challenges Amotekun DG’s appointment in court

The People’s Democratic Party in Osun State has dragged the state government before the Federal High Court sitting in Osogbo over the appointment of Mr. Amitolu Shittu as the state’s Director General of the Amotekun Security Corps.

Joined as defendants and co-defendants in the suit are: Governor Gboyega Oyetola, Osun State House of Assembly, Amitolu Shittu, Osun State Security Network Agency, the Nigeria Army, Nigerian AirForce, Commissioner for Justice and the Nigeria Security and Civil Defence Corps, among others.

The plaintiff, in an originating summons filed at the court, is seeking among others the following declarations: A declaration that under the provisions of the Osun State Security Network Agency and Amotekun Corps (Establishment) Law, 2020, the first defendant was not Justified in appointing the 3rd defendant as the Director-General of the Amotekun Corps, when there is no provision for such office in the law establishing the Amotekun Security Corps in Osun State, when the 3rd defendant is not a person that is knowledgeable, trained or skilled in security matters and when such an appointment has not gone through the confirmation of the 5th defendant.

“A declaration that the Osun State Security Network Agency (4th defendant) cannot function without inaugurating the relevant organs of the agency as established in the Amotekun Law of Osun State. 

“A declaration that the 1st defendant cannot, on the advice of the 2nd defendant, properly appoint the defendant or any person as the chairman of the Amotekun Governing Board and Amotekun Commander, without the input of the 5th defendant. 

“A declaration that the 5th defendants cannot, through their officers, staff and agents, properly recognise and/or have any dealing with the 4th defendant, as well as the 3rd defendant as the Director-General of Amotekun Corps in Osun State for the purpose of security collaboration, when there is no such office established under the Amotekun Law of Osun State, when the 3rd defendant is not a person that is knowledgeable, trained or skilled in security matters, and when such an appointment has not gone through the confirmation of the 5th defendant.

“An order of injunction perpetually restraining the 1st defendant from appointing the defendant as the Director-General of the Amotekun Corps, when there is no provision for such office in the law establishing the Amotekun Security Corps in Osun State, when the defendant is not a person that is knowledgeable, trained or skilled in security matters, when such an appointment has not gone through the confirmation of the 5th defendant.”

“An order of injunction perpetually restraining the 3rd defendant from functioning as the Director-General/head of Amotekun Corps in Osun State for the purpose of security collaboration, when there is no such office established under the Amotekun Law of Osun State, when the 3rd defendant is not a person that is knowledgeable, trained or skilled in security matters and when such an appointment has not gone through the confirmation of the 5th defendant.

“An order of injunction perpetually restraining the 5th and 4th defendants through their officers, staffs and agents from recognising and/or having any dealing with the defendant, as well as the 3rd defendant as the Director General of the Amotekun Corps, when there is no provision for such office in the law establishing the Amotekun Security Corps in Osun State, when the 3rd defendant is not a person that is knowledgeable, trained or skilled in security matters and when such an appointment has not gone through the confirmation of the 5th defendant.

“An order invalidating the appointment of the 3rd defendant as the Director-General of Amotekun Corps in Osun State, thereby removing him from office forthwith for reason of non-existence of such office under the Amotekun Law of Osun State, for reason of not being a person that is knowledgeable, trained or skilled in security matters and for the fact that such an appointment has not gone through the confirmation of the 5th defendant.”

No date has been fixed for the hearing of the matter.
